Agreement
By downloading or using PixKit, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. Who we are
The App is provided by QALA.DEV (“we,” “us,” “our”). These Terms form a binding agreement between you and us regarding your use of PixKit.
2. The service
PixKit is a creative photo-editing application. It includes a broad set of tools — for example, more than twenty filters, more than fifty custom fonts, overlays, text layers, filters, brightness and numerous other adjustments, plus standout features such as one-tap background removal (with optional custom solid background colors before you save) and one-tap background blur. Features may be updated over time. Editing is intended to run on your device; the App does not require you to sign in. We aim to keep the App useful and reliable, but we do not guarantee uninterrupted or error-free operation.
3. No account required
PixKit is designed to work without a user account. If we ever offer optional sign-in in a future version, we will describe how that works in the Privacy Policy and, where needed, update these Terms.
4. Your content
You retain rights to the photos and creative work you edit. You are responsible for ensuring you have the right to edit and share your content, and that your use of the App complies with law and third-party rights (including copyrights and likeness rights).
5. Acceptable use
You agree not to:
- Use the App in violation of law or third-party rights
- Use the App to create or distribute unlawful, harassing, or infringing content
- Attempt to disrupt, reverse engineer, or compromise the App or related services in ways that harm security or availability
- Resell or redistribute the App or misrepresent its origin
6. Intellectual property
The App, its branding, and its software (excluding your content and third-party materials) are owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable license to use the App as permitted by the app store and these Terms.
7. Disclaimer
The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Automated tools (including background removal and blur) may not be perfect for every image. We do not warrant that results will meet your requirements or be uninterrupted.
8. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for claims arising from the App is limited to the greater of (a) the amount you paid us for the App in the twelve (12) months before the claim or (b) zero if the App is free.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
9. Termination
You may stop using the App at any time by uninstalling it. We may suspend or update the App as permitted by the app store and applicable law. Provisions that by their nature should survive will survive termination.
10. Changes
We may update these Terms. We will post the new effective date on this page. Continued use after the effective date constitutes acceptance, except where applicable law requires additional notice.
11. Governing law
These Terms are governed by applicable laws, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
